1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of the websites, applications, at-home testing products, member and provider portals, and related services offered by Enamr Health ("Enamr Health," "we," "us," or "our") at https://www.enamrhealth.com and associated properties (collectively, the "Services").

By accessing or using the Services, creating an account, placing an order, submitting a specimen, or clicking to accept, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

2. Eligibility

• You must be at least 18 years old and able to form a binding contract.
• You must provide accurate registration, shipping, and health intake information.
• You may not use the Services if you are barred under applicable law or if we have suspended your account.
• If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

3. Health and medical disclaimers

Enamr Health provides wellness and laboratory testing services intended to inform you and, where applicable, your licensed healthcare providers. Our Services do not constitute medical advice, diagnosis, or treatment.

• Results are for informational and educational purposes unless otherwise specified in writing by a qualified clinician.
• Do not use the Services for emergency or urgent health needs. Call 911 or seek immediate in-person care.
• Always consult a licensed physician, dentist, or other qualified healthcare professional before making medical decisions based on test results.
• A provider relationship is not created solely by your use of the Services or receipt of a report.
• Laboratory methods, reference ranges, and interpretations may evolve; prior results may not be comparable to future reports.

4. Description of Services

We offer at-home oral health and microbiome-related testing, digital reporting, optional care products, waitlist and educational content, and provider collaboration tools. Features may change, and access may be limited by geography, laboratory capacity, or regulatory requirements.

5. Accounts and security

• You are responsible for maintaining the confidentiality of your credentials and for activity under your account.
• Notify us immediately of unauthorized access or suspected compromise.
• We may suspend or terminate accounts that violate these Terms, pose security risks, or are used fraudulently.
• Demo or pilot environments may contain sample data only and must not be used for real patient care decisions unless explicitly designated as production clinical workflows.

6. Orders, test kits, and laboratory testing

• You agree to follow all collection, shipping, and handling instructions included with your kit. Improper collection may invalidate results.
• You represent that any specimen submitted is your own (or that you are legally authorized to submit it on behalf of another, such as a parent or guardian).
• We may refuse, cancel, or delay orders for compliance, safety, suspected fraud, or inventory constraints.
• Turnaround times are estimates only and are not guaranteed.
• We work with qualified laboratories and partners; testing is performed under applicable laboratory standards where required.

7. Results and reports

Reports may include investigational or evolving biomarkers alongside validated assays. We strive for accuracy but cannot guarantee that results are error-free or complete.

You grant us permission to process your sample and data to generate results, improve our models (using de-identified data where feasible), and provide support.

8. Provider portal

Licensed providers accessing referral or patient dashboards must comply with professional standards, applicable privacy laws (including HIPAA where they are covered entities), and our separate provider policies. Providers are responsible for their clinical decisions and communications with patients.

9. Fees, billing, and refunds

• Prices, taxes, and shipping fees are shown at checkout or in an order confirmation and may change prospectively.
• Payment is processed by third-party processors; you authorize charges for orders you place.
• Refund and replacement policies for kits and tests will be posted at purchase or provided by support; opened or used kits may not be eligible for refund where processing has begun.

10. Acceptable use

• Do not misuse the Services, probe vulnerabilities, scrape without permission, or interfere with operation.
• Do not upload unlawful, infringing, or harmful content.
• Do not misrepresent identity, medical credentials, or test results.
• Do not resell kits or results except as expressly permitted in writing.

11. Intellectual property

All content, trademarks, software, report formats, and materials on the Services are owned by Enamr Health or our licensors. You receive a limited, non-exclusive, non-transferable license to access the Services for personal or authorized professional use. No rights are granted except as stated in these Terms.

12. Privacy and data collection

Our collection and use of personal and health-related information is described in our Privacy Policy at https://www.enamrhealth.com/privacy. By using the Services, you acknowledge that we may collect identifiers, contact information, order history, laboratory results, device data, cookies (as disclosed in our cookie notice), and communications you send to us, and that we may share information with service providers and partners as described in that policy.

13. Third-party services and links

The Services may link to third-party sites or integrate third-party tools (such as email, payments, or social media). We are not responsible for third-party practices; your use of those services is subject to their terms.

14. Disclaimers

EXCEPT AS EXPRESSLY STATED IN WRITING, THE SERVICES AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENAMR HEALTH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LABORATORIES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

16. Indemnification

You agree to defend, indemnify, and hold harmless Enamr Health and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.

17. Dispute resolution and governing law

Before filing a claim, you agree to contact us at the email below and attempt to resolve the dispute informally for at least thirty (30) days.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your state apply.

Except where prohibited by law, you and Enamr Health agree that disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in a class, consolidated, or representative action. You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing us with your name, account email, and a clear opt-out request.

Either party may seek injunctive relief in court for intellectual property misuse or unauthorized access.

18. Suspension and termination

We may suspend or terminate access to the Services at any time for violation of these Terms, risk to users, or legal requirements. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

19. Changes to these Terms

We may modify these Terms from time to time. We will post updated Terms on this page and update the Last updated date. Continued use after changes become effective constitutes acceptance, except where otherwise required by law.
